One of the more emotional aspects of a divorce is the determination of child custody between the parties. The basis upon which custody is determined by the court is always based upon what is determined to be in the best interests of the child(ren). Of course, parents are always free to address the child custody issues on their own and reach an agreement.
The information provided herein is very basic and does not reflect the intricate concepts or factors of child custody. Each child custody determination is fact sensitive and requires an in depth investigation of many factors and relevant facts.
Child custody requires a determination of what is referred to as legal custody and physical custody. Custody determinations will impact on who pays child support and who receives child support.
Physical custody is a determination as to with whom the child(ren) will live.
Legal custody reflects which parent shall make substantive determinations which impact the child(ren). Those areas usually involve such matters as major issue decision making, health, educational and, religious determinations. In some cases those decisions are made in part by one parent and others by the other parent.
In most cases it is appropriate to have both parents consult on those issues even if one has final decision making authority.
Child custody is categorized as sole custody, joint custody or shared custody. These concepts require a more in depth discussion specific to the facts of each party’s individual case.
It is important to keep the children insulated from the parties’ issues surrounding their divorce. While the parents are getting divorced the children are not.
